Terms of service

1. What the service is

VelTxt is a Shopify app that reads your store and writes and sends marketing text messages to customers of your store who have opted in to receive them. It writes five sets of messages — welcome, abandoned cart, abandoned checkout, browse abandonment and a weekly promo — which you can review, edit, switch off, or pause at any time.

The service is provided as it is. We do not guarantee any level of sales, revenue, delivery rate or engagement. Delivery of a text message depends on mobile carriers, which are outside our control.

2. Pricing and billing

• VelTxt is free to install. There is no monthly fee, no subscription, no per-contact fee and no share of your sales.
• You pay $0.020 per text message, in US dollars.
• You are only billed for a text once delivery is confirmed. A message that fails to deliver is not charged for.
• Billing is handled through Shopify's billing system, under Shopify's own terms.
• We may change our prices. If we do, we will tell you before the change takes effect, and you may stop using the app rather than accept it.

3. Consent is your responsibility

You are responsible for having proper, documented consent from every person you text through VelTxt. That means each recipient agreed to receive marketing text messages from your store, by an affirmative action they took themselves — for example ticking an unticked box at checkout or on a sign-up form on your store — and that consent was not made a condition of purchase.

You must not upload, import or otherwise send to phone numbers you bought, scraped, rented, or that opted in to some other business. You must honour opt-outs, and you must not attempt to circumvent an opt-out.

You are responsible for complying with the laws that apply to your messages, including the TCPA, CAN-SPAM, state telemarketing laws, applicable carrier rules and the CTIA messaging principles. We provide tools that help — opt-out handling, quiet hours, frequency caps and consent records — but the legal obligation is yours.

4. Acceptable use

You may not use VelTxt to send messages relating to any of the following categories:

• Alcohol
• Gambling
• Firearms and weapons
• Cryptocurrency and related investment offers
• Payday, short-term and high-interest loans
• Political messaging and campaigning
• Adult content

You also may not use VelTxt to send anything unlawful, deceptive, hateful, harassing, or promoting illegal drugs; to impersonate another business; to send phishing links or malware; or to send messages that a carrier would treat as spam. Carriers block these categories and will block the number, which affects every message you send.

If we find you are doing any of this, we may suspend sending immediately.

5. Your content and your store data

Your products, reviews, customer data and messages remain yours. You grant us permission to access and process them only so far as needed to operate the app for you. How we handle personal information is set out in the privacy policy.

You are responsible for the content of any message you edit or approve, including any claim it makes about your products.

6. Liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, lost sales, lost data or lost goodwill. We are not liable for fines or claims arising from messages you sent without proper consent.

Our total liability to you for any claim relating to VelTxt is limited to the amount you paid us for text messages in the three months before the claim arose.

Nothing in these terms excludes liability that cannot be excluded by law.

7. Ending it

You can stop at any time by uninstalling the app from your Shopify admin. Sending stops, and your customer data is deleted within 30 days as described in the privacy policy. You remain responsible for amounts already billed for messages already delivered.

We can end or suspend your access if you breach these terms, if a carrier requires it, or if we stop operating the service — in which case we will give you reasonable notice where we can.

8. Changes, law and contact

We may update these terms; the date at the top of this page shows when. Continuing to use the app after a change means you accept it. These terms are governed by the laws of the United States. Questions go to veltxt@shimistyle.me.
